These incidents can be reported to the welfare officer, a prevention consultant or the legal authorities.<\/p>\n<p>Acts of discrimination based on protected criteria, on sex (or a similar criterion) or on criteria linked to racism and xenophobia cannot be considered as breaches of integrity by the Act of 8 December 2022 either. Such acts can be reported to Unia or the legal authorities.<\/p>\n<h6><strong>Who can file a report?<\/strong><\/h6>\n<p>Anyone who has obtained <strong>information <\/strong>concerning a potential breach of integrity within the General Intelligence and Security Service (GISS) or State Security (VSSE) <strong>in a professional context<\/strong> can report it to the external reporting channel of the Committee.<\/p>\n<p>This can be staff members (current or former, contract, statutory or seconded), <strong>trainees<\/strong>, volunteers, <strong>self-employed workers<\/strong>, members of a partner service of GISS or State Security, <strong>suppliers<\/strong>, subcontractors, etc.<\/p>\n<h6><strong>Will my identity and my report remain confidential?<\/strong><\/h6>\n<p>We do not disclose the identity of the whistleblower. Your <strong>personal data<\/strong> and your <strong>report <\/strong>will be treated as strictly <strong>confidential<\/strong>. Within the Committee, only the members of the Integrity Cell have access to your information.<\/p>\n<p>Unless you consent, we reject any request for <strong>consultation, explanation or communication<\/strong> of a document that could reveal your identity.<\/p>\n<p>However, we may have to disclose your identity or information from which your identity can be inferred by virtue of a legal obligation, where this is necessary and proportionate under special legislation in the context of investigations by national authorities, or as part of legal proceedings. In such cases, we will inform you in advance of any such report, giving reasons, unless such information is likely to compromise the investigations or legal proceedings.<\/p>\n<h6><strong>Can I include classified or confidential information in my report?<\/strong><\/h6>\n<p>Under the &#8220;Whistleblowers&#8221; Act, <strong>the Committee cannot investigate reports relating to national security or classified information<\/strong>.<\/p>\n<p>Under this law, a report must be made without prejudice to the applicable rules:<\/p>\n<ul>\n<li>on classified information within the meaning of the Act of 11 December 1998;<\/li>\n<li>on information covered by medical secrecy;<\/li>\n<li>on information protected by professional secrecy of lawyers vis-\u00e0-vis their clients;<\/li>\n<li>on information covered by the secrecy of judicial deliberations;<\/li>\n<li>on information relating to criminal proceedings (and in particular the confidentiality of judicial information and instructions).<\/li>\n<\/ul>\n<p>This means that the rules protecting this information still apply; you are not exempt from these rules if you make a report.<\/p>\n<p>You may include in your report <strong>information that is confidential<\/strong> by virtue of a contract, business secrecy or legal provision other than those referred to above, provided that you have <strong>not committed a criminal offence<\/strong> in obtaining it.<\/p>\n<p>Finally, the Committee may in the context of its other responsibilities receive complaints and denunciations <strong>concerning national security<\/strong>. All staff of the Committee who handle complaints and denunciations have the required security clearance.<\/p>\n<p>If you are not sure whether we can help you, please get in touch in any case.
